Terms of Service & EULA
The agreement between you and Campus2Air. Please read it before using the service.
The short version
This summary is for convenience only. The full Terms below are what legally apply.
- Campus2Air only helps students find each other. We do not provide, arrange, drive, insure or supervise any ride.
- We are not responsible for anything that happens before, during or after the carpool matchmaking process, including the ride itself, and we take no liability for it.
- You ride and share rides at your own risk. We do not run background checks or verify anyone beyond their @ucr.edu sign-in.
- Rides must be cost-sharing only, never for profit.
- Campus2Air is not affiliated with UC Riverside.
- Disputes go to individual arbitration, not class actions, unless you opt out within 30 days (Section 26).
PLEASE READ THESE TERMS CAREFULLY. THEY CONTAIN AN ASSUMPTION OF RISK, A RELEASE OF CLAIMS, A WAIVER OF CALIFORNIA CIVIL CODE § 1542, LIMITATIONS ON OUR LIABILITY, AN INDEMNITY, A ONE-YEAR DEADLINE TO BRING CLAIMS, AND A BINDING INDIVIDUAL ARBITRATION AGREEMENT WITH A CLASS ACTION WAIVER (SECTION 26).
1. Agreement and Who “We” Are
These Terms of Service and End User License Agreement (the “Terms”) are a binding agreement between you and Campus2Air. They govern your access to and use of the Campus2Air website, web app, invite links, notifications and any related features (together, the “Service”).
“Campus2Air,” “we,” “us” and “our” mean the Campus2Air Service and each of the individuals who create, develop, design, operate, host, administer, maintain, moderate or contribute to it, together with their successors and assigns (collectively, the “Campus2Air Parties”). Every protection given to Campus2Air in these Terms, including every disclaimer, release, limitation of liability and indemnity, applies to each Campus2Air Party individually.
Who runs Campus2Air. Campus2Air is an independent, unincorporated, non-commercial project run by a small group of UC Riverside students (the “maintainers”). It is not a company and has no office or mailing address; the maintainers can be reached at the email address in Section 32.
How you agree. You accept these Terms by checking the box confirming that you are 18 or older and agree to these Terms and the Privacy Policy, and then signing in. Doing so is your electronic signature. You cannot use the Service without accepting them. If you do not agree, do not use the Service.
2. Eligibility
The Service is for adults who have a UC Riverside-issued Google account (an @ucr.edu address). To use it you must:
- be at least 18 years old and able to form a binding contract;
- sign in with your own valid @ucr.edu Google account and keep control of it;
- not have been previously suspended or removed from the Service; and
- not be barred from using the Service under any applicable law.
You may have only one account and may not share it or let anyone else use it. A @ucr.edu address does not prove that you are a current student, who you say you are, or that you are safe to travel with, and we do not treat it that way. You are responsible for all activity under your account. We may suspend any account we believe belongs to someone under 18 or who is otherwise ineligible.
3. No University Affiliation
Campus2Air is an independent project. It is not affiliated with, endorsed by, sponsored by, operated by or officially connected to the University of California, Riverside, the Regents of the University of California, or any of their departments, staff or student organizations (together, “UCR”). UCR has no responsibility for the Service. Using UCR sign-in to restrict access does not imply any UCR approval, oversight or involvement.
4. What Campus2Air Is, and Is Not
Campus2Air is a free matchmaking tool. It lets students post when and from where they are traveling to or from an airport, find others with similar plans, and share contact details with the people in their carpool. That is all it does.
Campus2Air is not:
- a transportation provider, taxi, rideshare or transportation network company, charter-party or for-hire carrier, or motor carrier;
- a driver, vehicle owner or employer or contractor of drivers;
- a broker, travel agent, booking agent, escrow agent, payment processor or insurer;
- a safety, security, emergency or monitoring service; or
- a party to any agreement between users.
We do not arrange, schedule, dispatch, provide, operate, track, supervise or guarantee any ride. Every ride, and every decision about whether, how, when and with whom to travel, is a private arrangement made solely between users. We do not charge for the Service. If we ever offer paid features, separate terms will apply and will be shown to you before you pay.
5. We Are Not Responsible for What Happens Before, During or After the Carpool Matchmaking Process
CAMPUS2AIR IS NOT RESPONSIBLE FOR ANYTHING THAT HAPPENS BEFORE, DURING OR AFTER THE CARPOOL MATCHMAKING PROCESS, AND TAKES NO LIABILITY FOR IT.
This applies to the fullest extent permitted by law; see Section 23.
To the fullest extent permitted by law, this includes, without limitation, anything arising out of or related to:
- any meeting, conversation, message, call or interaction between users, on or off the Service;
- any ride, trip, pickup or drop-off, including travel to, from or at any airport, campus, residence or other location;
- the conduct, condition, honesty, driving, vehicle, insurance, health or intentions of any user or third party;
- accidents, collisions, injuries, illness, death, assault, harassment, theft, loss of or damage to property or luggage, or criminal acts;
- delays, no-shows, cancellations, schedule changes, missed flights or connections, rebooking costs, lodging or other travel losses;
- payments, cost-sharing, reimbursements or disputes between users;
- traffic violations, tolls, parking, fines, towing or any law enforcement matter;
- information that users post or share, whether accurate or not; and
- any carpool being edited, transferred, disbanded, filled, expired or deleted.
Your relationship with other users is solely between you and them.
6. No Screening, Verification or Monitoring
Beyond requiring a @ucr.edu sign-in, we do not verify anyone's identity, enrollment, age, flight, phone number or other information. We do not run criminal background, driving record, sex-offender registry, license, insurance, vehicle or any other checks. We have no duty to screen, monitor, supervise, investigate, moderate or verify any user, listing, communication or ride, or to warn you about any user. We may review or remove content or accounts at our discretion, but doing so does not create any duty to do it again or at all.
7. Your Safety Is Your Responsibility
You are solely responsible for your own safety and for deciding whether to travel with anyone. We strongly encourage you to:
- confirm the other person's identity before getting into a vehicle (for example, check that their name matches the one shown in Campus2Air and agree on details beforehand);
- meet in public, well-lit places and tell a friend or family member your plans;
- share only what is necessary and never share financial or account information;
- trust your instincts and cancel if anything feels wrong; and
- in an emergency, call 911. Campus2Air is not an emergency service and cannot send help.
Following these suggestions does not make any ride safe, and their omission or inclusion does not create any duty or warranty on our part.
No monitoring or complaint handling. Campus2Air is run by students in their spare time. We do not monitor users, carpools or messages, and we do not take or investigate complaints about other users. If someone makes you feel unsafe, stop contact and leave the carpool; for emergencies or crimes, contact 911 or the police. We may, but are not required to, suspend accounts or remove carpools we believe break these Terms. Doing so in one case does not create a duty to do so in any other.
8. Drivers, Passengers and Vehicles
If you drive, you represent and agree that you will at all times hold a valid driver's license; maintain legally required automobile insurance; use a registered, safe and roadworthy vehicle; never drive impaired, fatigued or distracted; never carry more passengers than the vehicle has seat belts; and obey all traffic and other laws. If you ride as a passenger, you are responsible for your own conduct and belongings and for confirming that the driver and vehicle are suitable before you travel. Ride details such as pickup point, route, luggage space and timing are agreed between users, not by Campus2Air.
9. Cost-Sharing Only: No Rides for Profit
The Service may only be used to share the actual costs of a trip (for example, fuel, tolls or parking) on a non-commercial basis. You may not use the Service to offer or obtain rides for compensation that exceeds your share of those costs, to operate as a for-hire, rideshare or charter driver, or to advertise any business. Personal auto insurance may not cover trips made for profit, and for-hire transportation is regulated (including by the California Public Utilities Commission). Campus2Air does not collect, process, hold or guarantee any payment between users and is not responsible for any payment arrangement or dispute.
10. Your Information and Who Can See It
By using the Service you understand and agree that:
- other signed-in users can see your carpool's route, airport, date, time, seats and the first name and last initial of its organizer and members. They see flight numbers only as the airline code (for example “UA ••••”), unless they search for that exact flight number, in which case that one flight number is shown;
- members of a carpool can also see every flight number in it, its notes, and the phone numbers of the other members (and you theirs). Flight numbers appear in the carpool's flight list, not next to anyone's name;
- your email address is never shown to other users;
- anyone with an invite link, including anyone it is forwarded to and the link previews shown by messaging apps, can see the route, date, time and seats left without signing in, but no names, phone numbers, notes or flight numbers. After signing in, a person who is not a member sees what other signed-in users see (above); and
- once information is shared with another user, we cannot control what that person does with it.
You are responsible for the accuracy of what you post and for any information you choose to share. Our Privacy Policy explains what we collect and how we handle it, and is part of these Terms.
11. Acceptable Use
You agree not to, and not to help anyone else to:
- post false, misleading or duplicate listings, or impersonate any person;
- harass, threaten, stalk, intimidate, discriminate against or abuse anyone;
- collect, scrape, copy, sell or misuse other users' names, phone numbers or other information, or contact users for anything other than coordinating a shared ride;
- join or leave carpools to spam notifications, or try to get around join limits or other safeguards;
- use the Service for any commercial, advertising, political or unlawful purpose;
- use bots, scripts, crawlers or automated means to access the Service;
- probe, scan or test the Service's security, or access accounts or data that are not yours;
- interfere with, overload or disrupt the Service or its infrastructure; or
- violate any law or anyone's rights.
We may remove content, limit features or suspend or terminate accounts at our discretion for any violation, or for any conduct we believe is harmful.
12. Communications Between Users
Campus2Air does not provide in-app chat or calling. When you tap “Call” or otherwise contact another user, that communication happens through your own phone, carrier or apps, entirely outside the Service. We have no access to or control over those communications and are not responsible for them or for anything agreed, said or done in them.
13. No Guarantees About Matches, Listings or Notifications
We do not guarantee that you will find a match, that any carpool will happen or have room, or that any listing, flight, time, airport, seat count or other information is accurate, current or complete. Carpools are deleted automatically after their travel date as described in Section 5 of the Privacy Policy, and may also be closed by their organizer or by us, or lost without notice. Notifications, search results, invite links and other features may be delayed, incomplete or unavailable. Do not rely on the Service for time-critical travel plans; always confirm details directly with the other people involved.
14. License to Use the Service (EULA)
Subject to these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for your own non-commercial carpool coordination. You may not copy, modify, distribute, sell, rent, frame or create derivative works of the Service; reverse engineer or attempt to extract its source code except where the law expressly allows it despite this restriction; remove any notices; or use the Service to build a competing product. The Service, its design, code, text, graphics and the Campus2Air name and logo are owned by Campus2Air or its licensors, and all rights not expressly granted are reserved. If you send us feedback or suggestions, we may use them freely without any obligation to you. This license ends automatically if you breach these Terms or your access is terminated.
15. Third-Party Services
The Service relies on third parties, including Google (sign-in), Firebase, Vercel (hosting) and our database provider, and on phones, carriers, browsers and airlines that we do not control. We are not responsible for their availability, accuracy, security, terms or conduct. Your use of them is governed by their own terms.
16. Platform Immunity
Campus2Air is a provider of an “interactive computer service” under 47 U.S.C. § 230. We are not the publisher or speaker of information provided by users, and nothing in these Terms waives any immunity or protection available to us under § 230 or any other law.
17. No Agency or Partnership
No agency, partnership, joint venture, employment, franchise or fiduciary relationship exists between you and Campus2Air, or between Campus2Air and any user. Drivers and passengers are not employees, contractors or agents of Campus2Air, and no user can bind Campus2Air.
18. Assumption of Risk
YOU UNDERSTAND THAT MEETING, COMMUNICATING AND TRAVELING WITH OTHER PEOPLE, INCLUDING PEOPLE YOU DO NOT KNOW, INVOLVES INHERENT AND SERIOUS RISKS, INCLUDING PROPERTY DAMAGE OR LOSS, FINANCIAL LOSS, MISSED FLIGHTS, ILLNESS, PHYSICAL OR SEXUAL ASSAULT, SERIOUS INJURY AND DEATH. YOU KNOWINGLY, VOLUNTARILY AND FREELY ASSUME ALL OF THESE RISKS, KNOWN AND UNKNOWN, FOR ANY USE OF THE SERVICE AND ANY RIDE OR INTERACTION WITH ANOTHER USER, EVEN IF CAUSED IN WHOLE OR IN PART BY THE ACTS, OMISSIONS OR NEGLIGENCE OF OTHER USERS OR THIRD PARTIES.
19. Release of Claims and Waiver of Civil Code § 1542
TO THE FULLEST EXTENT PERMITTED BY LAW, YOU RELEASE, WAIVE AND FOREVER DISCHARGE EACH CAMPUS2AIR PARTY FROM ALL CLAIMS, DEMANDS, DAMAGES, LOSSES AND LIABILITIES OF EVERY KIND, KNOWN AND UNKNOWN, ARISING OUT OF OR RELATED TO THE SERVICE, ANY RIDE OR TRIP, OR ANY DISPUTE OR INTERACTION WITH ANOTHER USER OR THIRD PARTY, INCLUDING CLAIMS BASED ON THE ORDINARY NEGLIGENCE OF ANY CAMPUS2AIR PARTY. THIS RELEASE DOES NOT COVER A CAMPUS2AIR PARTY'S FRAUD, WILLFUL MISCONDUCT, GROSS NEGLIGENCE OR VIOLATION OF LAW, OR ANY OTHER LIABILITY THAT CANNOT LEGALLY BE RELEASED.
You expressly waive the benefits of California Civil Code § 1542, and of any similar law of any other jurisdiction, which provides:
“A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.”
You understand this means you are giving up claims you do not yet know about.
20. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, CAMPUS2AIR DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, SAFETY, SECURITY, AVAILABILITY AND QUIET ENJOYMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE OR FREE OF HARMFUL COMPONENTS, THAT DATA WILL NOT BE LOST, OR THAT ANY USER, LISTING OR RIDE WILL BE SAFE, ACCURATE, LAWFUL OR SATISFACTORY.
21. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW: (A) NO CAMPUS2AIR PARTY WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OPPORTUNITY, TRAVEL OR GOODWILL, OR FOR PERSONAL INJURY, EMOTIONAL DISTRESS, PROPERTY DAMAGE OR DEATH, ARISING OUT OF OR RELATED TO THE SERVICE, ANY RIDE OR ANY USER, HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY, EVEN IF ADVISED OF THEIR POSSIBILITY; AND (B) THE TOTAL LIABILITY OF ALL CAMPUS2AIR PARTIES COMBINED FOR ALL CLAIMS OF ANY KIND WILL NOT EXCEED FIFTY U.S. DOLLARS (US $50). THESE LIMITS ARE AN ESSENTIAL PART OF THE BARGAIN BETWEEN YOU AND US, WHICH IS PROVIDED FREE OF CHARGE, AND APPLY EVEN IF ANY REMEDY FAILS OF ITS ESSENTIAL PURPOSE. THEY DO NOT LIMIT LIABILITY FOR A CAMPUS2AIR PARTY'S FRAUD, WILLFUL MISCONDUCT, GROSS NEGLIGENCE OR VIOLATION OF LAW, OR ANY OTHER LIABILITY THAT CANNOT LEGALLY BE LIMITED.
22. Indemnification
You agree to defend, indemnify and hold harmless each Campus2Air Party from and against third-party claims, demands, liabilities, damages, losses, fines, costs and expenses (including reasonable attorneys' fees) to the extent they arise from: your violation of these Terms; your violation of any law or of anyone's rights; your conduct during any ride or trip you take, offer or arrange; or information you post or share. This does not apply to the extent a claim results from a Campus2Air Party's own negligence, gross negligence, willful misconduct, fraud or violation of law. We will tell you about a claim we ask you to cover, may choose to join in its defense with our own counsel, and you may not settle a claim that imposes any obligation on a Campus2Air Party without our written consent.
23. Where the Law Does Not Allow These Limits
Some laws do not allow certain warranties to be excluded or certain liability to be limited or released, such as liability for a party's own fraud, willful injury or violation of law, or for gross negligence. Where such a law applies, the affected exclusions, releases and limits apply only to the maximum extent that law permits, and the rest of these Terms continue to apply in full.
24. Termination and Account Deletion
We may suspend, restrict or terminate your access, remove any carpool or content, or discontinue the Service, at any time and for any or no reason, with or without notice, and without liability. You may stop using the Service at any time and may request deletion of your data as described in the Privacy Policy. Sections 1 and 3 to 32 survive any termination.
25. Time Limit to Bring Claims
TO THE FULLEST EXTENT PERMITTED BY LAW, ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE MUST BE FILED WITHIN ONE (1) YEAR AFTER IT ARISES, OR IT IS PERMANENTLY BARRED.
26. Dispute Resolution: Individual Arbitration and Class Action Waiver
Informal resolution first. Before starting any claim, you agree to send us written notice describing the dispute and the relief you want (see Section 32), and to try in good faith to resolve it with us for at least 30 days.
Binding arbitration. If the dispute is not resolved, you and Campus2Air agree that any dispute, claim or controversy arising out of or relating to these Terms or the Service, including whether this arbitration agreement applies, will be resolved by final and binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules then in effect, before a single arbitrator, in Riverside County, California or by video conference. The Federal Arbitration Act governs this Section. Fees are allocated as the AAA Consumer Arbitration Rules provide.
Small claims. Either party may instead bring an individual claim in small claims court in Riverside County, California, if it qualifies.
CLASS ACTION AND JURY WAIVER: YOU AND CAMPUS2AIR MAY BRING CLAIMS ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, CONSOLIDATED OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE CLAIMS OR PRESIDE OVER ANY FORM OF CLASS OR REPRESENTATIVE PROCEEDING. BY AGREEING TO ARBITRATION, YOU AND CAMPUS2AIR EACH WAIVE THE RIGHT TO A JURY TRIAL.
Exceptions. Claims for public injunctive relief that cannot be waived under California law will be stayed and decided by a court after the arbitration of all other claims. Either party may seek temporary injunctive relief in court to prevent irreparable harm, such as misuse of the Service or of user data.
30-day opt-out. You may opt out of this arbitration agreement by emailing the contact in Section 32 with your name and the @ucr.edu address you use on Campus2Air within 30 days after you first accept these Terms. Opting out does not affect any other part of these Terms.
Severability. If the class action waiver is found unenforceable for a claim, that claim must be decided in court, not arbitration. If any other part of this Section is found unenforceable, the rest remains in effect.
27. Governing Law and Venue
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules, and, for Section 26, the Federal Arbitration Act. Subject to Section 26, any claim that proceeds in court must be brought exclusively in the state or federal courts located in Riverside County, California, and you consent to their jurisdiction and venue.
28. Changes to the Service and These Terms
We may change, suspend or discontinue any part of the Service at any time. We may update these Terms by posting a new version with a new version number and effective date. For material changes, we will ask you to agree to the updated Terms the next time you sign in, and you cannot keep using the Service unless you do. Non-material changes, such as clarifications, take effect when posted. Changes to Section 26 will not apply to disputes we already know about.
29. Electronic Communications
You consent to receive notices, agreements and other communications from us electronically, including on the Service and by email to your @ucr.edu address. Electronic communications satisfy any legal requirement that a communication be in writing, and your checkbox acceptance is your electronic signature.
30. Force Majeure
We are not liable for any delay or failure caused by events beyond our reasonable control, including natural disasters, severe weather, epidemics, government action, war, terrorism, civil unrest, labor disputes, power, internet or hosting outages, cyberattacks, and failures of third-party services.
31. General
These Terms and the Privacy Policy are the entire agreement between you and Campus2Air about the Service and replace all prior versions and understandings. If any provision is held unenforceable, it will be enforced to the maximum extent permitted and the rest will remain in effect. Our failure to enforce any provision is not a waiver. You may not assign these Terms; we may assign them without restriction. There are no third-party beneficiaries, except that each Campus2Air Party may enforce the protections given to it. Headings are for convenience only, and “including” means “including without limitation.” If these Terms are translated, the English version controls.
32. Contact and Legal Notices
Questions, notices of dispute, arbitration opt-outs and other legal notices must be sent by email to legal-campus2air@proton.me. Campus2Air has no mailing address. Include your name and the @ucr.edu address you use (or used) on Campus2Air so we can identify your account; if you can no longer use that account, you may write from another email address. A notice to us is received when it arrives in that mailbox, and the maintainers check it about once a month. We may send notices to you by email to your @ucr.edu address or on the Service. Do not post legal notices or personal information publicly (for example, in the project's code repository).
